Welcome to Rackhouse Media Company (“Rackhouse Media,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your use of our website (rackhousemedia.com), services, and all related content, products, and offerings. By accessing or using our website or services, you agree to these Terms. If you do not agree, please do not use our services.

1. Services

Rackhouse Media provides photography, videography, media production, and related creative services. The scope of services will be outlined in a written proposal, contract, or agreement specific to each project.

2. Intellectual Property

All media created by Rackhouse Media (photos, videos, designs, edits, etc.) remains the intellectual property of Rackhouse Media unless otherwise stated in writing.

Clients receive a usage license as outlined in their project agreement (e.g., commercial use, promotional use, personal use).

Clients may not resell, alter, or misrepresent our work without written consent.

Rackhouse Media reserves the right to use completed projects in portfolios, promotional materials, and marketing unless otherwise agreed upon in writing.

3. Client Responsibilities

Clients must provide accurate information, timely feedback, and any required assets (e.g., logos, brand guidelines, location access).

Clients are responsible for securing necessary permissions for locations, people, or third-party materials.

Delays caused by the client may affect deadlines and/or incur additional costs.

4. Payment & Fees

Payment terms will be outlined in the project agreement or invoice.

Deposits/retainers are non-refundable unless stated otherwise.

Full payment is required before final delivery of media files.

Late payments may be subject to additional fees or interest.

5. Cancellations & Rescheduling

Cancellations made 30 days or more before the scheduled project may be eligible for partial refund (excluding non-refundable retainers).

Cancellations made within 30 days or less of the project date may result in forfeiture of all payments made (including retainer).

Rescheduling is subject to availability and may incur additional fees.

6. Deliverables & Revisions

Standard turnaround times and deliverables will be specified in the project agreement.

Clients are entitled to 3 rounds of revisions; additional revisions may be billed at an hourly rate.

Once final files are delivered, Rackhouse Media is not responsible for file storage, backups, or replacements beyond 30 days.

7. Limitation of Liability

While we strive for excellence, Rackhouse Media is not liable for unforeseen issues such as equipment failure, weather conditions, or circumstances beyond our control.

Liability for any claim shall not exceed the total amount paid by the client for the specific project.

Rackhouse Media is not responsible for indirect, incidental, or consequential damages.

8. Confidentiality & Privacy

Rackhouse Media respects client confidentiality and will not share sensitive information without consent.

Personal information collected through rackhousemedia.com is governed by our Privacy Policy.

9. Website Use

The website rackhousemedia.com and all content are protected by copyright and may not be copied, distributed, or used without permission.

Users may not use our website for unlawful purposes or attempt to gain unauthorized access to systems or data.

10. Governing Law

These Terms are governed by the laws of the State of Kentucky, without regard to conflict of law principles.

11. Changes to Terms

Rackhouse Media may update these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms.
